Privacy PolicyThis Privacy Policy ("Privacy Policy") applies to all information that Party Joy, (the "Site") located at the domain name http://partyjoy.ottawa.tilda.ws (and its sub-domains), may obtain about the User during the use of the website http://partyjoy.ottawa.tilda.ws (and its sub-domains), its programs and its products.
1 Definition of Terms1.1 The following terms are used in this Privacy Policy:
1.1.1 "Site Administration" (hereinafter - the Administration) - authorized employees to manage the Party Joy website, acting on behalf of Zotova Irina. who organize and/or carry out the processing of personal data, as well as determine the purposes of personal data processing, the composition of personal data to be processed, actions (operations) performed with personal data.
1.1.2. "Personal data" - any information relating to directly or indirectly identified or defined by an individual (personal data subject).
1.1.3. "Processing of personal data" - any action (operation) or a set of actions (operations) performed with or without the use of automation means with personal data, including collection, recording, systematization, accumulation, storage, clarification (update, change), extraction, use, transfer (distribution, provision, access), anonymization, blocking, removal, destruction of personal data.
1.1.4 "Confidentiality of personal data" - a mandatory requirement for the Operator or other person granted access to personal data to prevent their dissemination without the consent of the subject of personal data or availability of other legal grounds.
1.1.5. "Party Joy Website" means the aggregate of interconnected web pages located on the Internet at the unique address (URL): http://partyjoy.ottawa.tilda.ws, as well as its sub-domains.
1.1.6. "Subdomains" are pages or a set of pages located on third level domains belonging to Party Joy site, as well as other temporary pages with contact information of the Administration indicated at the bottom
1.1.5. "Party Joy Website User" (hereinafter referred to as the User) - a person who has access to Party Joy Website through the Internet and uses information, materials and products from Party Joy Website.
1.1.7. "Cookies" - is a small data fragment sent by a Web server and stored on a user's computer, which a Web client or Web browser sends to a Web server each time it attempts to open a page on the corresponding site.
1.1.8. "IP-address" is the unique network address of the node in a computer network, through which the User gains access to the Site.
1.1.9. "Product" - a product, which the User orders on the Site and pays for via payment systems.
- General Provisions
2.1 The use of Party Joy website by the User implies consent to this Privacy Policy and the terms of processing of personal data of the User.
2.2 In the event of disagreement with the terms of the Privacy Policy, the User must cease using the Party Joy site.
2.3. This Privacy Policy applies to the Party Joy website. The site has no control over and is not responsible for the websites of third parties to which the User can go through the links available on the Party Joy site.
2.4. The Administration does not verify the accuracy of the personal data provided by the User.
3. Subject of Privacy PolicyThe present Privacy Policy states the Administration's obligations regarding nondisclosure and protection of personal data provided by the User at the Administration's request when registering on the Party Joy website, subscribing to the e-mail newsletter or placing an order.
Personal data which may be processed under this Privacy Policy is provided by the User by filling out the forms on the Party Joy web site, and includes the following information
3.2.1. the last name, first name, patronymic of the User;
The contact phone number of User. 3.2.2;
3.2.3. email address (e-mail)
3.2.4. what would you like to see at the event? (if necessary)
3.2.5. desired date and time of the event (if necessary)
3.3. The site protects the data automatically transmitted by visiting the pages:
- IP address;
- information from cookies;
- browser information
- access time;
- referrer (address of the previous page).
3.3.1 Disabling cookies may result in inability to access parts of the site requiring authorization.
3.3.2 The site collects statistics about the IP addresses of its visitors. This information is used to prevent, detect and resolve technical problems.
3.4 Any other personal information not mentioned above (history of visits, browsers used, operating systems, etc.) shall be stored securely and not disclosed, except as specified in paragraphs 5.2. and 5.3. of this Privacy Policy.
4. Purposes of collection of user's personal information4.1 The Administration may use the User's personal data for the purposes of:
4.1.1 Identify the User registered on the Party Joy website for his further authorization, order placement and other actions.
4.1.2 Providing the User with access to personalized data on the Party Joy website.
4.1.3. Establishing feedback with User, including sending notices, requests regarding the use of the Party Joy website, the provision of services and the processing of requests and applications from User.
4.1.4 Identifying the location of the User for security purposes and fraud prevention.
4.1.5 Confirming the accuracy and completeness of the personal data provided by the User.
4.1.6 Creating an account to use parts of the Party Joy site, if the User has given his consent to create an account.
4.1.7 Notifying the User by email.
4.1.8 Providing effective technical support to User when problems arise with the use of the Party Joy Site.
Providing special offers, price information, newsletters and other information on behalf of Party Joy site to User with User's consent.
4.1.10. Performing advertising activities with the consent of the User.
5. Methods and terms of personal information processingProcessing of personal data of the User shall be performed without limitation of time, by any legal means, including information systems of personal data with or without the use of means of automation.
5.2 The User agrees that the Administration has the right to transfer personal data to third parties, in particular, courier services, postal organizations (including electronic), telecommunication operators, solely for the purposes of the User's order executed on Party Joy site, including delivery of goods, documentation or e-mail messages.
5.3 Personal information of the User may be disclosed to authorized governmental bodies.
5.4 In case of loss or disclosure of personal data, the Administration has the right not to inform the User about the loss or disclosure of personal data.
5.5 The Administration shall take necessary organizational and technical measures for protection of personal information of the User from unauthorized or accidental access, destruction, change, blocking, copying, distribution, as well as from other unlawful actions of third parties.
5.6 The Administration together with the User shall take all necessary measures to prevent losses or other negative consequences caused by the loss or disclosure of the User's personal information.
6. Rights and obligations of the parties6.1 The User shall have the right to:
6.1.1. Make a free decision to provide his personal data necessary to use the Party Joy website and give consent to its processing.
6.1.2 Update and supplement the provided information on personal data in case of changes in such information.
6.1.3 The User has the right to obtain information from the Administration regarding the processing of its personal data, unless such right is limited in accordance with the federal laws. The User shall be entitled to demand from the Administration clarification of its personal data, their blocking or destruction if personal data is incomplete, outdated, inaccurate, illegally obtained or is not necessary for the stated purpose of processing, as well as to take statutory measures to protect its rights.
6.2 The Administration shall:
6.2.1 Use the received information solely for the purposes specified in Clause 4 of this Privacy Policy.
6.2.2 Keep confidential information secret, refrain from disclosure without the prior written permission of the User, and not to sell, exchange, publish or disclose in any other ways the User's personal data, except for items 5.2 and 5.3. 5.2 and 5.3. of this Privacy Policy.
6.2.3 Take precautionary measures to protect the confidentiality of the User's personal data, according to the procedure generally used for the protection of such information in the existing business turnover.
6.2.4 To block Personal Data, which pertains to the relevant User, from the moment of application or request of the User, or his/her legal representative, or authorized body for the protection of the rights of subjects of personal data for the period of inspection, in case of detection of unreliable Personal Data or unlawful actions.
7. Responsibility of the parties7.1 The Administration which has not fulfilled its obligations shall be liable for losses incurred by the User in connection with the unauthorized use of personal data in accordance with the law, except the cases provided by paragraphs. 5.2, 5.3 and 7.2 of this Privacy Policy.
7.2 In the event of loss or disclosure of Confidential Information, the Administration shall not be liable if this confidential information:
7.2.1. Was in the public domain prior to its loss or disclosure.
7.2.2. was received from a third party prior to its receipt by the Website Administration.
7.2.3 Was disclosed with the User's consent.
7.3 The User is solely responsible for complying with the laws, including but not limited to the laws on advertising, on protection of copyright and neighboring rights, on protection of trademarks and service marks, including full responsibility for the content and form of Materials.
7.4 The User acknowledges that any information (including but not limited to: data files, texts, etc.) to which the User may have access as part of the Party Joy site is the responsibility of the person who provided such information.
7.5 The User agrees that the information provided to him as part of the Party Joy site may be an object of intellectual property, the rights to which are protected and belong to other Users, partners, or advertisers who place such information on the Party Joy site.
The User shall not modify, rent, lease, loan, sell, distribute, or create derivative works based on such Content (in whole or in part) unless such actions have been expressly permitted in writing by the owners of such Content pursuant to the terms of a separate agreement.
7.6 The text materials (articles, publications in free public access on Party Joy) shall be allowed for distribution provided there is a link to the Site.
7.7 The Administration is not responsible to the User for any loss or damage incurred by the User as a result of the deletion, failure or inability to save any content or other communication data contained on, or transmitted through, Party Joy site.
7.8 The Administration is not responsible for any direct or indirect damages resulting from: the use or inability to use the site or individual services; unauthorized access to communications of the User; statements or behavior of any third party on the site.
7.9. The Administration shall not be liable for any information posted by the User on Party Joy site, including but not limited to: information protected by copyright, without the express consent of the copyright owner.
8. Resolution of disputes8.1 Prior to recourse to court for disputes arising from the relationship between the User and the Administration, it is obligatory to submit a claim (written or electronic proposal for voluntary settlement of a dispute).
8.2 The recipient of the claim shall notify the claimant of the results of consideration of the claim in writing or electronically within 30 calendar days from the date of receipt of the claim.
8.3 If no agreement is reached, the dispute will be referred to the Arbitration Court of Ottawa, Canada.
9. Additional Terms9.1 The Administration has the right to make changes in this Privacy Policy without the User's consent.
9.2. The new Privacy Policy shall take effect upon its posting on the Party Joy website, unless otherwise stipulated by the new Privacy Policy.
